Part 1
The guideline is meant to give an overview of the possibilities and conditions of
entrepreneurial activities in Germany.
1. Trade and commercial regulations
When realizing gainful employment of foreigners in Germany, there are four
possibilities to distinguish:
1.1 Using the services of a commercial agent in Germany
I n a first phase, the foreign entrepreneur can work with an independently operating
commercial agent in Germany who will sell the foreign products on behalf of the
foreign enterprise here in Germany. The commercial agent is self-employed and in
general only has to register his/her commercial activity with the local authority like
any other person carrying on a trade in Germany, too (so-called trade license, costs
